SCIENTIFIC DNA TEST IN THE FILIATION

Abstract

The truth in the test is one of the most studied topics, since it depends on it that a trial can be won or lost; the test as many of the elements of the law has evolved, today and the reason for the present work, we will study some scientific proof and very specific to the DNA test processes descent, however, this type of test is performed in various procedures, the second most recurrent being the criminal; as such proof rotates relative to body fluids, why, the most important issue in relation to this lies evidence in the fundamental rights of the taxpayer thereof, as to obtain, as mentioned will be obtained fluids and for which it is via introduction of needles or isopos, affecting the right to free body disposition; and in the study of genetic markers, a major problem has been the existence of a DNA test data bank that entails due confidentiality.
