VIOLENCE AND HARASSMENT AT WORK: AN ANALYSIS OF THE NEW CONCEPT OF THE 190TH ILO CONVENTION

This paper intends to contrast the concept of violence and harassment at work established by the new ILO regulation (Convention No. 190 and Recommendation No. 206) with the current state of affairs at international, European and national levels, taking in this last case as reference the Spanish labour law. In this sense, the objective is to verify what is new and if it represents a real extension in terms of prohibited behaviours and protected subjects, on which the preventive, sanctioning and reparative action contemplated in ILO Convention will be deployed, if it becomes ratified by the member states. This requires a prior review of the regulatory framework and, subsequently, an exegesis of the precepts of the new ILO regulations that define its scope.
