THE VICTIM ON THE BRAZILIAN CRIMINAL PROCEDURE – AN ANALYSIS OF THE PENAL PROCEDURE CODE ARTICLE 201 AND ITS NECESSARY EFFECTUATION

The present study aims to analyze the effectiveness of the article 201 of the Brazilian penal procedure code, introduced with the mini procedural reform of 2008. With that objective, will be studied initially the general aspects about the victim of crimes, and its relation with the penal and procedure penal law. In the second part of the study an analysis of the effectiveness of the current norm will be done, notably in what concerns the victim’s condition of subject of rights and its current position as mere mean of acquirement of evidence in the procedural system, as its reflexes in the criminal politics of protecting rights structure.
