Abstract

This article aims to establish the problem of the declaration of the victim of gender violence given asymmetric relationships; for this, the way in which the victim's right to testify and its procedural consequences have been addressed are explained; it is proposed to consider the witnesses of reference as a way of clarifying the facts and punishing the criminal act; To do this, it is essential to modify the way in which cases are resolved where women are victims of violence, which cannot be resolved from the perspective of the assessed assessment of the evidence.
