VIOLATION OF SOCIAL MIDIAS AS EVIDENCE IN THE CRIMINAL PROCESS

The present research aims to analyze the limits of the criminal procedural activity about evidences regarding the violability of privacy and intimacy of the person, user of social medias. In this study, it will be necessary to be taken in consideration the interaction between the human dignity’s right and the private life will be covered in view of the use of information from social medias by government agencies who takes care of investigate the criminal prosecutions, bringing the idea of Robert Alexy's maxim of proportionality. This study will be analyzed by the perspective of Brazilian legislation, jurisprudence and doctrine, valuing, therefore, the dignity of the human person.
