The present scientific article seeks to analyze, through qualitative research, with an exploratory profile, based on the techniques of bibliographic and documentary review of the juristocracy in Brazil and its side effects as a way to mitigate the realization of human rights by the jurisdiction in the making of judicial decisions uncompromised with the Constitution of the Federative Republic of Brazil and with the International Treaties and Conventions to which Brazil is a signatory in the treated subject
