JUDICIAL MEASURES TO GUARANTEE THE RIGHT TO EDUCATION OF CHILDREN WITH DISORDERS OF THE AUTISTIC SPECTRUM

Abstract

In this paper I intend to describe and analyze the close link between the right to education of people with intellectual disabilities in general and the activation of legal resources to enforce them. Specifically, I will refer to the claims of families with children or adolescents with autism spectrum disorders in Argentina. I will describe what supports you have requested for these students to develop an efficient transit through formal schooling. Taking these judicial measures as a starting point, I will describe briefly the Argentine system of comprehensive coverage of benefits for people with disabilities, which has been in force for more than twenty years. It is a system of solidarity collaboration of all the contributors to those who require benefits in health and rehabilitation due to a disability. However, despite the existence of norms that recognize these rights, judicial protection is required to effectively enforce them. To carry out this legal action requires the professional training of lawyers specialized in the disability field. I will tell you how to carry out this specialization from the School of Law of the University of Buenos Aires, with undergraduate, postgraduate, research projects and a free legal service for people who can not afford the cost of a private lawyer. Finally, to analyze results, I will summarize the content of three legal cases developed in the Argentina against institutions that provide therapy and rehabilitation services. These three trials were promoted by the families of children with autism spectrum disorders and sponsored free of charge by the Professional Practice team specialized in disability, from the School of Law of the University of Buenos Aires.
