The CNJ and gender equality in the judiciary:
formation of a diverse proposal in the light of the European precedents

This article deals with the issue of gender equality in the occupation of positions by women in the 2nd degree of jurisdiction in the Brazilian Judiciary and the creation of a policy to mitigate gender asymmetries through the judgment handed down by the National Council of Justice (CNJ) in normative act 0005605-48. 2023.2.00.0000, which resulted in CNJ Resolution 525/23 and established the creation of a mixed list (with men and women) and a single list (with only women) for the merit criterion in promotions to the post of judge in courts with a gender underrepresentation. Based on the precedents of the Court of Justice of the European Union, the article aims to present a divergent view from those presented in the aforementioned judgment, in the sense of applying the theory of intersectionality and the multidimensionality of oppressions to the issue in order to extend the policy to people who have personal issues with multiple aspects of vulnerability. The aim of this paper is to broaden the debate, considering affirmative action to be fundamental to tackling gender issues in conjunction with other social markers, such as ethnic-racial and people with disabilities, with the aim of moving towards joint and community civilizational progress.
