RACE AGAINST TIME: A STUDY ON THE DISAPPEARANCE OF CHILDREN AND THE ALERT AND SAFETY MECHANISMS

Abstract

The article is the result of a project developed with the objective of addressing the issues involving
the disappearance of children: family and institutional contexts for the promotion of human rights.
Since then, there have been several changes to the institutes, especially to ensure the promotion of
human rights. Thus, at present, the themes of human rights law have been present in innovative
decisions within the Brazilian Judiciary, reexamining concepts, pushing away dogmas that are no
longer in line with social reality. The Institute of Human Rights being a solution of the Democratic
State as guarantor of judicial protection, in which individuals, have the freedom to constitute their
families. In this context, an accurate study of the institutes involving missing persons from the
dictatorship to the present day and their family and institutional context is necessary. However, the
disappearance of children means that they have a legal profile, a recurring fact on the social level,
and the right cannot refrain from regulating such situations. Being necessary supportive actions,
preventive actions in guaranteeing the human rights of children.
