REGLAMENTO LABORAL COMUNITARIO. EL PAPEL DE LA AUTORIDAD LABORAL EUROPEA
Abstract
The European Labor Authority is a must to ensure that the EU labor mobility rules are implemented
fairly, simply and effectively. The proposal for a Regulation creating the European Labor Authority
was published by the European Commission on March 13, 2018 and Regulation (EU) 2019/1149 of
the European Parliament, creating a European Labor Authority. The new European structure. with
the status of EU decentralized agency, it will support self-employed workers in the EU, but also other
EU or non-EU citizens legally residing in the EU and in a cross-border situation, practically in support
of all people who are subject to EU rules on cross-border labor force mobility and social security
coordination. The Authority's main objectives are to help ensure fair labor mobility within the Union
and to help Member States and the Commission to coordinate social security systems in the Union.
The newly established Authority shall enjoy in each Member State the widest legal capacity accorded
to legal persons under its national law. One of the main tasks of the European Labor Authority is to
coordinate and support joint and concerted inspections. Therefore, at the request of one or more
Member States, the Authority will coordinate and assist in concerted or joint inspections in areas that
are within the competence of the Authority. The Authority may also, on its own initiative, propose to
the authorities of the Member States concerned to carry out a concerted or joint inspection.
