This article, by the deductive method, analyzes the recognition of the
fundamental rights of criminal victims and identifies the phenomenon of victimization,
as well as international and national regulations recognizing such rights. Also
pointing out that Brazil does not enforce them, so much so that it violated, and
continues to violate, several rights of victims of crimes committed in its territory.
Thus, in addition to pointing out Brazil's convictions before the IACHR, focusing on
the similarities of the violated rights and on the inertia in domestic criminal
prosecution procedures, the research seeks to evaluate possible paths for the
realization of such rights in the Brazilian legal system.
