FUNDAMENTAL RIGHTS OF VICTIMS: from anthropological foundations to the (un)certain future.

The methodology used was the deductive method through bibliographic research,
which showed that the atrocities resulting from the 2nd World War, which generated
a macro victimization never experienced, gave rise to the recognition of the victims'
rights, through the creation of international norms, such as the Universal Declaration
of Human Rights, and domestic norms. Research has shown that, even though it is
the basis of international recognition of human rights, in practice, the realization of
the rights of victims of crime has been forgotten and is far from desirable, so much
so that the Brazilian State violated, and continues to violate, such rights, as
recognized by the Inter-American Court. In this scenario, it is inferred that the future
of victims' rights requires the international community to play a less diplomatic and
more effective role to ensure authentic jurisdictional protection at an international
level, capable of replacing the national one, when it is insufficient or non-existent in
the effectiveness. of such rights.
