The several crises and the effects of climate change are not restricted to one or more countries, however, it is notable that emerging countries suffer more intensely due to internal conflicts and natural disasters and, therefore, the number of migrants (people) who are forced to leaving their homes tends to grow. The article has the purpose to analyze, through a qualitative exploratory-descriptive approach, the application of international treaties in relation to migrants/refugees arising from natural disasters and its impacts on socio-environmental justice, with experiences from the public policies formulated and implemented in Brazil, also considering the judicialization of the migratory issue in the superior courts.
