CIVIL LIABILITY OF THE LEGAL PERSON IN ENVIRONMENTAL DAMAGES
Abstract
The present study analyzes the responsibility for degradation to the environment in Brazil and the
importance of prevention and inspection, as the protection outlined in law no. 6.938 / 81, which
provides for the National Environment Policy, is not enough. The environmental issue occupies space
everywhere in the world, with discussions on the forms of protection and non-degradation. It happens,
however, that in search of economic development it can result in environmental degradation, if there
are no means for its prevention. In this light, this article aims to point out the legal nature of civil liability
of the legal person and the framework given to them in cases of environmental damage. It also seeks
to identify which civil liability is appropriate for those who cause damage to the environment, whether
at full risk or not, taking as an example the case of Brumadinho, in Minas Gerais
