Abstract

This research aims to analyze the parameters and limits of transferability causa mortis of the
obligation to perform. Through the analogy of the current legislation and the earlier devices, the
jurisprudential and doctrinal concepts, different perspectives can be assed, as well as the conclusion
that it is possible to transmit to the heirs of de cujus an obligation to perform, of fungible nature.
