MEDICAL CONDUCT IN THE CARE FO PATIENTES WITH RELIGIOUS RESTRICTIONS
Abstract
The present study aims to analyze medical procedures confronted with religious restrictions, in case
of blood transfusion to Jehovah’s Witnesses and the refusal of surgical interventions motivated by
religious belief. This study will cover the interaction of religious freedom with the right to life and the
cases in which there is the coalition of rights in order to perform the proper procedure. In addition, the
physician’s criminal liability in relation to refusal of treatment-oriented conduct as the most effective
method of cure or better treatment for the patient’s illness will discuss, and the physician’s legal duty
is bound to do so. This study will analyze through religious aspects, medical ethics and law in order
to apply grounded methods through weighting judgment based on the principles of reasonableness
and proportionality, thus valuing the dignity of human person.
