THE EXT 1362 IN THE SFC: PRESCRITIBILITY OF CRIMES AGAINST HUMANITY, THE EXTRADITION PROCESS IN BRAZIL AND JUS COGENS
Abstract
The text aims to present and address the issue of understanding the statute of limitations of crimes
against humanity in Brazil, addressing the most relevant aspects of the subject, notably about the
extradition process and the cogent nature of international norms related to these crimes.
Methodologically, we carried out a qualitative research in a case study of the Extradition Process n.
1362, in which we obtained as a result that crimes against humanity are imprescriptible, in
disagreement with the decision of the Supreme Court in the aforementioned extradition process. The
importance of this theme is given by the instrumental and essentially jurisdictional character of the
theme.
