CONTROL OF ADEQUACY OF PUBLIC HEALTH SERVICES BY THE BRAZILIAN COURTS OF AUDITORS

The objective of this investigation is to analyze the possibility of verifying the adequacy of public health services in the logic of External Control by the Courts of Auditors, in the brazilian constitutional order, in order to stimulate the efficient realization of the fundamental social right to health. Methodologically, a hypothetical-deductive approach is adopted, establishing initial conjecture, to be verified based on bibliographic and legislative research techniques. From the research it is contacted that, in compatibility with the Constitution of 1988 and other infraconstitutional norms, it is possible the accomplishment of the control of adequacy by the Cortes de Contas, with potential to stimulate the adequate rendering of health actions and services, especially in the context of the fiscal regime instituted by the Constitutional Amendment no. 95/2016
